Terms of Use
The rules that apply to this website and to the concierge services we provide — written to be read, not skipped.
1. Acceptance of these terms
These Terms of Use (the “Terms”) govern your access to and use of this website and any travel concierge or lifestyle service provided by Clay Next T LLC. By browsing the site, sending us a request or accepting a quotation, you agree to be bound by these Terms and by our Privacy Policy.
If you do not agree with them, please do not use the site or our services. Where we sign a separate written agreement, retainer or statement of work with you, that document prevails over these Terms to the extent of any conflict.
2. Who we are
Clay Next T LLC — a limited liability company formed under
the laws of the State of Wyoming, United States.
30 N Gould St, Ste N, Sheridan, Wyoming 82801, United States
Email: concierge@claynextt.com
We provide travel concierge and lifestyle services: travel arrangements, accommodation, transportation, event ticket sourcing and other personalised booking and coordination services. In these Terms, “we”, “us” and “our” mean Clay Next T LLC; “you” and “your” mean the client, and any traveller on whose behalf the client is acting.
3. Our role as intermediary
This is the most important clause in this document. We act as an agent and coordinator on your behalf. We are not an airline, hotel, car rental company, chauffeur service, charter operator, restaurant, event promoter or ticket issuer, and we do not own, operate or control any of them.
Every flight, room, vehicle, table, ticket and experience we arrange is supplied by an independent third party (a “Supplier”) under a contract formed directly between you and that Supplier. Our contract with you is for the concierge service — sourcing, advising, booking, confirming and coordinating — and not for the underlying travel product itself.
We select Suppliers with care and follow arrangements through, but we are not responsible for a Supplier’s acts, omissions, delays, overbooking, insolvency, service standards or safety practices.
4. Eligibility
You must be at least 18 years old and legally able to enter into binding contracts. If you are booking for other travellers, you confirm that you are authorised to act on their behalf, that you have shared these Terms with them, and that you accept these Terms for them as well as for yourself. Bookings for minors must be made by a parent or legal guardian.
5. Requests, quotations & confirmation
- Sending us a brief creates no obligation on either side. It is a request, not a booking.
- We respond with a proposal setting out the arrangements, the Supplier costs and our service fee.
- Prices, availability and exchange rates are indicative until booked. Travel inventory moves quickly, and a quotation may expire or change before you approve it.
- Nothing is booked until you approve the total in writing and, where required, funds have cleared. Your written approval, given by email or message, is your instruction to us to contract with the Suppliers on your behalf.
- A booking is confirmed only when we send you a written confirmation with the relevant Supplier references.
Descriptions, photographs and stated response times on this website are illustrative and do not form part of any contract.
6. Fees & payment
- Service fee. Our fee is quoted per request, or agreed as a monthly retainer for ongoing clients, and is disclosed before you approve anything.
- Supplier costs. Flights, hotels, cars, tickets and similar items are passed through to you at cost, as quoted.
- Currency. We invoice in EUR unless agreed otherwise. Where a Supplier charges in another currency, the amount invoiced reflects the rate applied at the time of booking; your bank may apply its own conversion and fees.
- Method. Payment is by bank transfer to the account shown on the invoice. We do not accept cash. We will never notify a change of bank details by email alone — if you receive such a message, call us before paying.
- Timing. Invoices are payable by the due date stated on them. Deposits or full prepayment may be required where a Supplier demands it.
- Late payment. Unpaid invoices may attract interest at 1.5% per month, or the maximum permitted by applicable law if lower, together with reasonable recovery costs. We may suspend work on open requests while an invoice is overdue.
- Taxes. Amounts are exclusive of any tax, duty, tourist tax or levy imposed by a destination or Supplier, which remains your responsibility.
7. Supplier terms
Each booking is subject to the Supplier’s own terms and conditions — fare rules, hotel policies, rental agreements, ticket conditions and conditions of carriage — which may limit or exclude their liability to you. We will make the material terms available to you before you approve a booking, and by approving it you accept them.
Many travel products are non-refundable or carry restrictive change rules. We flag this when it applies, but the Supplier’s rules, not ours, determine what can be changed or recovered.
8. Documents, visas & health
You are responsible for holding valid passports, visas, permits, entry authorisations, vaccination certificates and any other documentation required by your itinerary, and for meeting the health and insurance requirements of each country you enter or transit.
We will point out obvious requirements as a courtesy, but our information is general and not legal or immigration advice. Requirements change without notice; verify them with the relevant embassy, consulate or official government source. We are not liable for denied boarding or entry, or for any cost arising from missing, expired or incorrect documentation, or from names that do not match travel documents exactly.
Travel insurance is strongly recommended for every trip, and may be mandatory for some destinations. Unless expressly stated, we do not provide, sell or arrange insurance.
9. Changes, cancellations & refunds
Changes you request
Ask us as early as possible. We will seek the change with the Supplier, but we cannot guarantee it. Supplier change fees, fare differences and rate increases are payable by you, and an additional coordination fee may apply to complex rearrangements.
Cancellations by you
- Cancellation requests must be sent to us in writing and take effect when we acknowledge receipt.
- Supplier cancellation charges apply as set out in that Supplier’s terms, and can be up to 100% of the amount paid.
- Our service fee is earned when the work is performed and is non-refundable once we have sourced and booked the arrangements, including where the Supplier subsequently cancels.
- Where a Supplier does issue a refund, we pass it on to you as soon as we receive it, less any charges the Supplier has deducted. Supplier refunds commonly take 30 to 90 days, and that timing is outside our control.
- Refunds are returned to the account from which payment was received.
Cancellations by us
We may decline or discontinue a request — including where a booking cannot be made safely or lawfully, where a Supplier cannot be verified, where payment is not received, or where the conduct required of us would be unreasonable. In that case we refund any fee for work not yet performed.
Statutory rights
Nothing in this section removes any non-waivable right you may have under the consumer or package travel law of your country of residence.
10. Event ticket sourcing
- We source tickets through official channels and vetted resale partners. Availability and price vary by event and can change within minutes.
- Resale prices may exceed face value. The price we quote is the price you approve; we do not add undisclosed margins.
- We do not guarantee that any specific event, seat category or block can be obtained. If we cannot source a ticket safely, we say so and refund any amount paid for it.
- Entry is controlled by the event organiser and venue. Organisers may postpone, relocate, restrict or cancel events, and may impose their own conditions of entry, including name-matched or transfer-restricted tickets.
- Where an event is cancelled or postponed, any refund follows the organiser’s or reseller’s policy. We assist with the claim; we cannot compel a refund.
- You are responsible for complying with the ticket terms, including any resale prohibition.
11. Your responsibilities
- Give us accurate, complete information — including names exactly as they appear on travel documents — and tell us promptly if anything changes.
- Check every confirmation we send and report any error immediately. Corrections made late may carry Supplier fees.
- Pay invoices by the due date.
- Behave lawfully and respectfully towards Suppliers and their staff. Costs, fines or damages resulting from your conduct are yours.
- Keep us reachable while travelling so that we can help when plans change.
12. Acceptable use of the website
You agree not to:
- use the site for any unlawful, fraudulent or harmful purpose;
- submit false information, impersonate another person or send another person’s details without authority;
- attempt to gain unauthorised access to the site, its server or any connected system;
- introduce malware, or interfere with the operation or security of the site;
- scrape, harvest or systematically extract content, or use automated tools to flood the contact form;
- reproduce, resell or exploit any part of the site for commercial purposes without our written consent.
We may suspend or refuse access to anyone who breaches this section, and report serious misuse to the competent authorities.
13. Intellectual property
The Clay Next T name, logo, site design, text, layout and compilation are owned by Clay Next T LLC or licensed to us, and are protected by copyright, trade mark and other laws. Photographs are used under licence from their respective copyright holders. You may view and print pages for your own personal, non-commercial use; all other rights are reserved.
Itineraries and proposals we prepare for you are provided for your own use and may not be published or passed to another agency to be executed without our consent.
14. Disclaimers
The website and its content are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that the site will be uninterrupted or error-free, that content is complete or current, or that any particular Supplier, price, availability, upgrade, table or ticket can be secured. Response times, statistics and destination counts shown on this site are indicative, not guaranteed.
We do not provide legal, immigration, medical, tax or insurance advice.
15. Limitation of liability
To the fullest extent permitted by applicable law:
- We are not liable for any act, omission, default, delay, cancellation, overbooking, injury, illness, loss, damage or insolvency caused by a Supplier or by any third party outside our reasonable control.
- We are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, nor for loss of profit, revenue, opportunity, data or enjoyment, even if advised of the possibility.
- Our total aggregate liability arising out of or in connection with a booking or request — whether in contract, tort (including negligence), statute or otherwise — is limited to the service fee actually paid to us for that booking or request.
Nothing in these Terms excludes or limits our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded. Some jurisdictions do not allow certain exclusions, in which case the limitations above apply only to the extent permitted there.
Claims must be brought within one (1) year of the event giving rise to them, unless a longer period is required by law.
16. Indemnity
You agree to indemnify and hold harmless Clay Next T LLC, its member, officers and contractors against any claim, loss, liability, fine or reasonable cost (including legal fees) arising from your breach of these Terms, your misuse of the site, inaccurate information you provide, your conduct towards a Supplier, or your failure to hold the documentation required for your itinerary.
17. Force majeure
We are not liable for any failure or delay in performing our obligations caused by events beyond our reasonable control, including war, civil unrest, terrorism, strikes, air traffic control restrictions, airport or port closures, adverse weather, natural disaster, epidemic or pandemic, government action, border closures, sanctions, or failure of power, telecommunications or internet services. Where such an event occurs, we will use reasonable efforts to rearrange your plans, but Supplier charges remain subject to Supplier policy.
18. Complaints & disputes
Tell us while you are travelling if something is wrong — most problems can be solved in the moment. If you remain dissatisfied, write to concierge@claynextt.com within 30 days of the end of the relevant arrangement, setting out the facts and the outcome you seek. We will acknowledge within 5 business days and aim to resolve the matter within 30 days.
Complaints about a Supplier’s own service must generally be pursued with that Supplier; we will support you with references, evidence and correspondence.
The parties will attempt to settle any dispute in good faith before commencing proceedings.
19. Governing law
These Terms and any dispute arising out of them or out of our services are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. The state and federal courts located in Sheridan County, Wyoming shall have exclusive jurisdiction, and both parties submit to that jurisdiction.
If you are a consumer resident in the European Union, the United Kingdom or another jurisdiction whose law grants you mandatory protections, this clause does not deprive you of the protection of the mandatory rules of your country of residence or of your right to bring proceedings there.
20. General
- Entire agreement. These Terms, together with any written proposal or retainer we have signed with you and our Privacy Policy, form the entire agreement between us.
- Severability. If a provision is held unenforceable, the remainder stays in force and the provision is applied to the maximum extent permitted.
- No waiver. Failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign your rights without our consent. We may assign to a successor of our business.
- Third parties. No one other than you and us has any right to enforce these Terms.
- Notices. Notices are validly given by email to the addresses last used between us.
- Changes. We may update these Terms. The version published on this page at the time you approve a request is the version that applies to it. Material changes will be notified to active clients by email.
- Language. These Terms are drafted in English, and the English text prevails over any translation.
